Terms and Conditions

 Welcome to www.lotezystore. The terms and conditions applicable to

your access and use of the websites, mobile sites, mobile applications

and other portals owned, operated, branded or made available by

lotezystore from time to time.

For the purpose of the Terms and Conditions (hereinafter referred to as “T&C”), wherever the context so requires, ‘you’ and ‘your’ shall relate to any natural or legal person who has agreed to become a seller on the Platform by providing registration data while registering on the Platform using computer systems. The word ‘user’ shall collectively imply a seller, a buyer, and any visitor on the Platform and the terms ‘we’, ‘us’ and ‘our’ shall mean Lotezy store.

Your use of the Platform and the features therein is governed by the following terms and conditions (T&C) including applicable policies available on the Platform, notifications and communications sent to you on the Platform which are incorporated herein by way of reference. If you transact on the Platform, you shall be subject to the policies that are applicable to the Platform for such a transaction. By mere use of the Platform you shall be contracting with Lotezy store, and these terms and conditions including the policies constitute your binding obligations to Lotezy store.

When you use any current or future services provided by us through the Platform you will be subject to the rules, guidelines, policies, terms and conditions applicable to such services and they shall be deemed incorporated into the T&C and considered a part and parcel of the T&C. We reserve the right, at our sole discretion, to change, modify, add, or remove portions of the T&C at any time. We will notify you through any of the communication modes as mentioned in this T&C in case of any changes or updates to the T&C that materially impact your use of the Platform.  Your continued use of the Platform following the changes or updates will mean that you accept and agree to the revisions. As long as you comply with the T&C, we grant you a personal, non-exclusive, non-transferable, and limited privilege to enter and use the Platform.

A.               Becoming a Member : -

               In order to become a member of Lotezy Store a person must visit our site or open the lotezystore app and install the same. Which will allow the customer to purchase online. The present Terms and Conditions apply to any order placed by a customer to this e-commerce website. When placing an order via the lotezystore, the Customer must explicitly accept the present Terms and Conditions.

B.                Registrations : -

               In the course of your use of the Platform, you agree to furnish your details and information as requested by us from time to time. You shall remain responsible for maintaining confidentiality of this information, as well as your display name, login and password details. The user ID and password is unique to a single account. You agree that if you provide any information which is untrue, inaccurate, not current, or incomplete or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, incomplete, or not in accordance with the T&C, we shall have the right to suspend or terminate your account on the Platform or indefinitely block you from accessing the Platform.

C.               Purchase Procedure : -

                When the user login to the account they can view all the categories of the product and sub categories of the same. Where the customer can view the products online, keep buying the product or add to cart as per their wish and also they can block the products for 4 hrs (in that 4hrs the selected product will be blocked) the customer can visit the shop and view the product which they have selected, they can touch and feel the product which they have selected called as touch option. If they customer does not visit the shop in said time the product will unblocked automatically.

D.              Acceptance of order : -

               Your order is an offer to buy from us. We will send you an order acknowledgement email detailing the products you have ordered. Nothing that we do or say will amount to any acceptance of your offer until we send you an email notifying you of the order acknowledgment. At this point, a contract will be made between us for you to buy and for us to sell the products that you have ordered from us.

E.                Delivery : -

                   Delivery of the product is done within 24hr from the time of the order received. The goods are delivered to the address of the Customer which is been added at the time of placing an order. Any visible damage and/or qualitative deficiency of an item or other defect upon delivery should be reported immediately to the Customer care. If it is delayed the company is not at all responsible, and the refund also cannot be claimed.

F.                 Payment Details : -

                The payment facility provided by lotezystore is neither a banking nor financial service, but merely a facilitator providing an electronic, automated online electronic payment facility for receiving payment, or cash on delivery (CoD) payment, collection and remittance for transactions on the Platform using the existing

authorized banking infrastructure and credit card payment. Further, by providing payment facility, lotezystore neither acts as a trustee nor fiduciary with respect to transaction or transaction price.

 G.              Warranty : -

                 In order to make a warranty claim, the Customer must be able

to submit proof of purchase.  Customers are recommended to keep the

original packaging of the goods. For items purchased online and

delivered to the Customer’s home, the Customer must contact the

customer service of and return the item to at his own expense. If a

defect is discovered, the Customer must inform lotezystore as soon as

possible. Warranty of the product is based upon the warranty issued by

 the manufacturer and it varies from item to items. After this period,

there are no further entitlement to repairs or replacement. The

(commercial and/or legal) warranty shall never apply to defects due

to accidents, negligence, falls, use of the item for purposes it is not

intended for, non-compliance with the user instructions or manual,

changes or modifications made to the item, hard-handed usage, bad

maintenance or any other abnormal or incorrect usage. Defects that

appear after a period of 6 months from the date of purchase or

delivery is not deemed to be hidden defects, unless the Customer

can provide evidence to the contrary.

 H.              Cancellation of the Products : -

             The customer has all right to cancel the order as per their request. However, the online transaction charges will not be refunded. The cost of delivering and re-picking charges will apply if the product has been shipped.  I.                  Return Policy/ Exchange of the Product : -

               Goods returned within seven days will be exchanged for items of

the same value, provided that the goods returned have not been used in

any way and is not opened with original invoice as well as matching with

the serial number. Goods returned should be in their original condition and

packaging. The item are unworn, unwashed, not used, altered, soiled or

damaged and in a saleable condition. Returned product needs to be in a

condition deemed fit for resale. If the product is found to be not working

properly or having any manufacturing defects, the same need to be sent

for repair.  If the item is not repairable, then it will be exchanged for the

same value.

J.                  Refund : -

             There is no option for refund the amount in cash or to bank. It will

be credited to your wallet in lotezy store and same can be used to purchase

any item from that shop for same value. You can pay extra in cash or online

payment if purchased product price is more than the wallet amount.

 All complaints, if any, can be directed to this customer service.

 L.                Offer : -

                  The offer is valid subject to availability of the product and can be

changed or revoked by lotezystore at any time. Lotezystore cannot

 be held liable for the unavailability of a product. If an offer is of

 limited duration or subject to conditions, this is explicitly

 mentioned in the offer.

M.              Privacy : -

               The personal data communicated by you will only be used for the

 following purposes: performance of the agreement entered into,

 processing of the order, sending of newsletters. You have a legal

 right to access or correct your personal date. If necessary, you can

 also ask to correct the data that are incorrect, incomplete or

 irrelevant. In case of use of data for direct marketing: You have the

 right to object, free of charge, to any further processing of your data

 for direct marketing.

 N.              Right to suspend or close your account : -

               We may suspend or close your account immediately at our

 reasonable discretion or if you breach any of your obligations under

 these Terms and Conditions. You will not be able to order products

 on the lotezystore site if your account is suspended or closed.

 O.               Changes to the Terms and conditions : -

                 The present Terms and Conditions are supplemented by other

terms and conditions specifically referred to, and by the general terms

and conditions of lotezystore. In case of contradictions, the present Terms

and Conditions shall prevail. We reserve the right to change these Terms

& Conditions for buying products online from time to time. If this

happens, we will notify you by posting the new Terms & Conditions for

buying products online on the website. If you do not wish to be

governed by the revised Terms & Conditions for buying products

online, you must not place any further orders.
